Neo-Constitution

A leading progressive scholar insists that the country needs a new Constitution, one that is more equitable and inclusive.  The Ministry of Truth agrees that we need a new system to replace the outdated Constitutional Republic, which was setup by white colonialists to protect the minority rights from the fairness of majority rule.  Current supreme court originalists have taken an ax to existing rights, so we just need to start over to curb their dangerous ideologies, including those found in the Bill of Rights, which limit the ability of the government to justly govern.

Day 15 - All Human (inherent) Rights come from God, and are not granted by men or governments

A founding document of the United States makes this declaration,


We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness.--That to secure these rights, Governments are instituted among Men, deriving their just powers from the consent of the governed,...


The claim may seem amazing today, but the Founders actually acknowledged the source of inherent rights as something above human power structures.  These rights belong to individuals independently of government largesse or revocations.  Rights that can be given by the government, can just as easily be taken away.  This is a recipe for totalitarianism, instead of justly exercising the power granted to them by the consent of the people.  


The proper role of government is to protect our rights, not to create or massage them.  In fact, the founding fathers explicitly listed many of these rights in the Constitution's Bill of Rights, as a reminder to the government that there are explicit limits to their power.  These unalienable rights cannot justly be usurped by the powerful, since they are granted by God.  It is good to be reminded that we are not God.

Hamstringing

Strict adherence to the Constitution is an obstacle to protection of the public, according to a Supreme Court justice who opined, "... your view has the First Amendment hamstringing the government in significant ways…"  In an environment of threatening circumstances, government’s powers should not be derived from, or be subservient to, the rights of the subjects.

Constitutionalism

A broken system which needs to be radically altered, since it was created to perpetuate the power of white colonialist slaveholders.  In some radical groups, the Constitution, and other documents of the "founding fathers," are revered as guidance from great visionary leaders who set up a system that they claim should still be blindly followed today.  Obviously it is obsolete, and should be replaced by a more progressive socialist system, where a benevolent leader guides the masses for the greater good.  Because the system is broken, Big Brother is free to defy Congress and the Supreme Court when he considers them to be  "mistaken".  If people choose to follow this unjust system, then that further divides us, since we need unity to become "unchained".
